2. We sell tickets to purchasers of tickets ("You", "Your") offered via this website as per the following terms and conditions;

If the name listed at 1. above is Ticket Solutions Pty Ltd then this web site and the web site oztix.com.au (the "Oztix Website") are owned and operated by Ticket Solutions Pty Ltd t/as Oztix and We provide ticketing services via the websites as the authorised agent of event organisers, such as artists, venues or event promoters (the 'Presenter') and any tickets purchased from this website are purchased from Us as the agent of the Presenter. Any dispute you have relating to an event or ticket purchase is between you and the Presenter. As agent for the Presenter, We are not liable for any claims relating to an event or ticket purchase, except as otherwise set out in these terms and conditions.

If the name listed at 1. above is a name other than Ticket Solutions Pty Ltd t/as Oztix then We sell tickets offered via this website as the event organiser ("Presenter", "We", "Us", "Our") and any tickets purchased from this website are purchased from Us as the presenter. Any dispute you have relating to an event or ticket purchase is between You and Us. In this instance Oztix is a company we have engaged to provide a software platform and related services to facilitate sales of tickets. Oztix are not selling the tickets nor acting as agent the Presenter nor as merchant for the sales of tickets. The website oztix.com.au (the "Oztix Website") is owned and operated by Ticket Solutions Pty Ltd (ACN 106 907 206) t/as Oztix ("Oztix") of PO Box 476, Annerley, 4103, Queensland, Australia. If you buy tickets from the Oztix Website you are subject to Oztix’s Terms and Conditions and may (or may not, as the case may be) be subject to the Terms and Conditions following.
5. The Presenter nor Oztix are not liable for any claims relating to an event or ticket purchase, except as otherwise set out in these terms and conditions.

What you are agreeing to
6. By visiting, using or purchasing any tickets via this website you agree to be bound by these Terms and Conditions and Our Privacy Policy.
7. Every ticket sold through this website is also subject to:
a. the Oztix additional term and conditions (please see Oztix's website); or as the case may be
b. the Presenters additional term and conditions (please see Oztix's website); and
c. any terms and conditions of the venue at which event is held (please see the venue’s website); and
d. any terms and conditions that may be printed on the ticket or on signage at the event entrance.
8. The Presenter reserves the right to add, withdraw, reschedule or substitute artists and/or vary programs, prices, venues, seating arrangements and audience capacity and the terms and conditions.
9. All Ticket Customers consent to be filmed and or recorded as members of the audience.

Use of this Web Site
10. Use of this website is restricted to personal use and reference only.

Conditions of Sale
11. All Prices quoted are in Australian Dollars and include local taxes (GST) where applicable.
12. Online sales will cease when the allocation of tickets is sold, at a time otherwise specified or usually 2 hours before doors open for the event.
13. The Presenter or Oztix reserve the right not to sell tickets to any person, agent or company.
14. Tickets will be delivered to you by the method you select during the booking process. If tickets are sent using Registered Post or a Courier service they will only be sent to addresses where the purchaser can sign for delivery. Mail delivery option will cease to be offered 10 days before the event.
15. Tickets may not, without the prior consent of the Presenter, be resold or offered for resale at a premium over the face value of the ticket (including via on-line auction sites) or used for advertising, promoting or other commercial purposes (including competitions and trade promotions) or to enhance the demand for other goods or services either by the original purchaser or any subsequent ticket holder.
16. Notwithstanding these terms and conditions, if You use a "disposable" or "temporary" credit card (such as those purchased over the counter at supermarkets) for Your online purchase We are not able to make any refund to you unless a) you can provide full details of the credit card; b) the credit card remains valid; and c) you can produce the online purchase receipt.
17. Your Credit Card statement will itemise a purchase as a charge from "Ticket Solutions Pty Ltd Pty Ltd."

Refunds and exchanges
18. The Presenter will only refund tickets in accordance with these terms and conditions and to the extent permitted by law. The Presenter or Oztix has no liability to you.
19. We do not replace any lost, stolen or destroyed tickets or exchange or substitute tickets after purchase, except in limited circumstances. We reserve the right to charge you a reasonable fee for the replacement of tickets. Please treat your tickets like cash, as we cannot replace lost tickets.
20. The Presenter reserves the right to alter the date, the venue and the entertainment and activities as advertised, without prior notice to you. Your entitlement to a refund in such circumstances is determined by the Presenter. Please contact Us for details in this instance in order to determine your eligibility for a refund.
21. If the date, time or venue of an event is rescheduled or changed, your ticket will remain valid for the rescheduled date, time and venue.
22. Ticket holders will not be financially penalised or disadvantaged for requesting a refund after not attending due to sickness or illness. Refunds will be provided to anyone that develops symptoms, without imposing any restrictions/conditions on the Ticket holder.
23. Any refund payable can only be made back to the credit card (whether temporary or otherwise) used in the original transaction.
24. We will post any relevant information regarding any cancelled or rescheduled events on our website when applicable. It is your responsibility to check our website for information in relation to any events.

No Show / Failure to collect tickets / Delivery fulfilment

25. We fulfil Our commitment to you for the sale of tickets by either mailing or emailing the ticket to you, or by making the ticket available at the door or Box Office for you to collect. If you have elected to receive the tickets by mail or email and have not received your ticket(s) within 48 hours of the event, please contact Oztix.

VIP Packages
26. We sell tickets coupled with other offerings such as VIP experiences, music, merchandise etc. (So called "Bundled Sales"). We cannot be held liable or responsible for the non-delivery of any goods or services that have been Bundled with Tickets as we have no control or oversight over how the fulfilment or delivery of Bundled Sales are managed. It is a condition of sale that all claims about non-delivery of Bundled Sales must be taken up direct with the Presenter. Please contact Us for details in this instance.

Pay Over Time Payment Option
27. In some circumstances, You may be able to pay for Your ticket over time, in instalments. If both parties agree to this payment option, You agree that We can charge your credit card a deposit, a booking fee (if any) and the number of specified instalments prior to sending you a confirmed ticket.
28. You agree that you only have a reservation for a ticket and are not entitled to an actual ticket to the relevant event until the full payment of the ticket and associated fees is made to Us.
29. If your credit card details change prior to your payment of any instalment due, you agree to contact Us to update your credit card details.
30. You agree that if, for any reason, We are not able to process any of the instalments on their due date, Your reservation for the ticket will be cancelled and your deposit and any booking fee paid shall be forfeited by You to Us.
31. If we do cancel your reservation, We agree to repay any instalment (other than the deposit and any booking fee) you have paid to Us back to the credit card you specified at the time of selecting the pay overtime option, provided that credit card remains valid.

Changes to Terms and Conditions
32. The terms and conditions that apply to any particular transaction will be the published terms and conditions at the time the transaction was finalised. Subject to the preceding sentence, We may alter or change the terms and conditions as they appear on our website from time to time effective immediately from posting on the web site. You should periodically check this page of the web site to ensure that you are aware of the latest terms and conditions.

What happens if you have an inquiry or complaint?

33. For inquiries or complaints regarding the sale and delivery of tickets please contact us by email c/o info@oztix.com.au or telephone 1300 762 545.
34. For inquiries or complaints regarding the staff and / or amenities at a venue or event, please contact the venue management.
35. For inquiries or complaints regarding the event, the artist's performance, sound or lighting or production quality, please contact the Presenter.

Data Security
36. When We process your order We collect your credit card and personal information in accordance with Our Terms and Conditions, our Privacy Policy and our Privacy Collection Notice.
37. If you are concerned about using your credit card online please contact us for assistance.
38. If you deny or dispute a charge on your credit card made by us, please contact us immediately. We consider credit card fraud to be a serious offence and we aim to prosecute each case to the fullest extent possible.

Copyright and Trademark
39. The images, text, logos and artwork contained within the Presenters website and the Oztix website site are copyright to Presenter, Oztix and/or the relevant licensors. All rights are reserved. Unauthorised use by way of copying, storage, reproduction, publishing electronically or otherwise transmitting in any form or by any means in whole or in part is prohibited. The Oztix logo is a registered trademark.

Disclaimer and liability

40. You accept that the Internet is not always a reliable and that system outages may occur. Save to the extent set out in the Competition and Consumer Act 2012 (Cth) (including the consumer guarantees under Australian Consumer Law) or otherwise permitted by law, the Presenter or Oztix will not be liable for any damages direct, incidental, consequential or otherwise, loss or corruption of data, loss of profits, goodwill, bargain or opportunity or loss of anticipated savings resulting from your purchase of any tickets or your access to, or use of, or inability to use the web site and its content, whether based in contract, tort, negligence, statute or any other legal theory, and whether or not We know of the possibility of such damage.

Choice of Law
41. Unless otherwise specified in the Presenters own terms of Sale or Entry these Terms and Conditions shall be governed by the laws of the State of Queensland, Australia but legal proceedings may be commenced in any Australian State or Territory.

Australian Consumer Law

42. Our goods and services come with consumer guarantees that cannot be excluded under Australian Consumer Law. Those consumer guarantees apply in addition to any other express warranties which we provide under this Agreement. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage.

Conditions of Entry - COVID 19 – Specific Conditions

43. Any person who enters the event must comply with all laws, regulations, directions and rules issued by the Victorian or Commonwealth Government or any government authority or by the show organiser relating to the spread of Coronavirus (COVID-19). This may include, without limitation, being required to submit to temperature checks prior to entry or within the venue, providing contact details via the Check-In procedure implemented by the show organiser, using sanitiser, adhering to physical distancing and density measures and where specifically requested, wearing a mask. A person must prior to entry to the show organiser make a declaration of, or otherwise respond truthfully to any questions in relation to:

44. Any person entering the venue MUST Check-In to the event via the QR Code located at the gate and scan their ticket in order to be granted access to the venue and must ensure that all details provided at the time of Check-In are accurate.

45. Any person exiting the event MUST Check-out of the venue via the QR Code located at the gates and rescan their ticket.

46. Any person who is exhibiting any symptoms of COVID-19 may, in order to protect other patrons and venue and show organiser staff be:

General Conditions

47. Persons will only be admitted entry if they possess a valid ticket which must be presented for inspection at the point of entry of the venue.

48. You must retain your ticket at all times while in the venue and you must produce your ticket if requested by any personnel of the show organiser.

49. The show organiser reserves the right, with reasonable cause, to refuse entry, remove or evict any person from the venue, with or without a refund, including where in the opinion of any personnel of the show organiser believes that a person may be showing symptoms of COVID-19, or has been provided information that a person has been a close contact of an individual with COVID-19. The show organiser will also remove or evict a person if they cause or threaten to cause any disturbance or disruption of any kind, a risk to safety or security or the enjoyment of the show by any other person or, is likely to breach, has threatened a breach or has otherwise breached these terms or conditions or refuses to comply with any reasonable request or direction made by the show organiser.

50. Visitors must be able to produce evidence of proof of purchase (receipt) for any product they are removing from the venue to event security when exiting the grounds if asked. The show organiser reserves the right to check the contents of bags to match the item with the product description on the receipt or proof of purchase. It is the responsibility of the visitor to obtain a receipt of proof of purchase from the exhibitor when making a purchase.

51. You must comply with any reasonable directions given by the show organiser and the security arrangements for the event and the venue which may include ceasing to participate in certain conduct and searches of clothing and possessions and prohibition of certain items such as knives, umbrellas, glass, illegal items, protest or political paraphernalia, items considered to be offensive, vehicles or other transportation devices (except as required because of a disability), alcohol, animals and items which may cause nuisance or danger as determined by the show organiser.

52. Appropriate footwear must be worn within the venue at all times. The show organiser reserves the right to refuse entry to, remove, or evict any person considered not suitably attired.

53. No animals are permitted within the show buildings or grounds at any time except as otherwise permitted by these terms and conditions. All domestic dogs and guide or companion animals required for persons with disabilities and as certified by law are permitted within the grounds.

54. Any animal entering the grounds must be under your control at all times, and in the case of dogs, must be maintained on a lead and under the control of a person capable of restraining it. No animal may be left unattended at any time inside or near the grounds (including by being tied up, left unattended, or left in a vehicle whether inside or outside of the grounds). You will remain liable for any loss or damage caused by any animal brought by you into the grounds. Any person who leaves any animal unattended whether inside or outside of the venue (including in a vehicle) will be reported to the appropriate authorities immediately. You must clean up after any animals brought by you into the grounds.

55. Exhibitors at the show reserve the right to refuse entry to their exhibits to any animal and any person accompanying that animal.

56. The show organiser reserves the right to refuse entry to, remove or evict any person bringing an animal to the show in circumstances where the animal presents or is deemed to present a risk to the health and safety of any person.

57. If you bring children into the event you are responsible for their care and conduct. All children attending the event must be under the supervision of an adult guardian at all times. You are responsible for any acts or omissions committed by children whom you have brought to the event

58. Smoking is not permitted in the venue unless otherwise advised by the show organiser in writing. To the extent expressly permitted, smoking areas in the venue precinct will be clearly designated.

59. Alcoholic beverages are not permitted to be brought into the grounds at any time. Alcohol may only be consumed in the grounds within designated areas and no Alcohol is to be removed from, or consumed outside of, those designated areas.

60. You must not interfere with, tamper, disrupt, damage or otherwise deface any exhibit or the property of any other person within the venue. You must not erect or display any banners or signage in the venue without the prior written consent of the show organiser.

61. You acknowledge and agree that you are liable for any damage caused by you as a result of your entry into the venue and attendance at the show (including any clean up, rectification, replacement or repair costs).

62. Without limiting these conditions, you must not participate in, and will be removed from the venue if in the opinion of the event organiser you have, or have threatened to, act in an inappropriate manner (including conducting any protests or acting in any aggressive, riotous, abusive, offensive, racists, sexist, or insulting manner towards other persons).

63. Persons gaining unauthorised access or entry to the event may be liable for prosecution.

64. Caravan Industry Victoria (show organiser) reserves the right to cancel, withdraw, postpone or reschedule the event or any displays or events in the event.

65. Caravan Industry Victoria (show organiser) does not represent that there will be space for you to observe any particular displays in the event.

66. Caravan Industry Victoria (show organiser) reserves the right to prohibit the use of cameras, audio and video recorders. You may use these types of personal devices for private use only and with the permission of stand operators and the show organiser.

67. You consent to being photographed, filmed and recorded as a member of the event audience. Unless otherwise agreed with the show organiser, you consent to the show organiser and third parties using images and recordings of you for broadcast, publication and licensing without compensation or acknowledgement.

68. Unless authorised by the show organiser in writing, you must not conduct any commercial, political, soliciting, promotional, performance, surveying or demonstration activity at the venue, nor collect contributions or distribute any material.

69. To the fullest extent permitted by law, the show organiser will not be liable for any injury, loss or damage suffered by you in connection with the event or the venue, including liability for any injury, loss or damaged caused or contributed by the show organiser or its employees, contractors or agents, whether in contract, tort (including negligence) or otherwise.

70. If the liability of the show organiser may not be excluded but may be limited under any law, the show organiser’s liability is limited to replacing, re-supplying or repairing the relevant goods or services (or paying for replacement, resupply or repair). Without limiting the foregoing, the show organiser is not liable for any injury, loss or damage caused or contributed by any matter outside the show organiser’s reasonable control (e.g. industrial strikes and acts of God).

71. Any personal information collected by the show organiser will be subject to the show organiser's privacy policy which can be located on its website at https://gomakesomememories.com.au

72. Nothing in these Conditions of Entry is intended to exclude, restrict or modify rights which you may have under consumer protection legislation which may not be excluded, restricted or modified by agreement. Any part of these Conditions of Entry which is unenforceable may be severed to the extent necessary to make these Conditions of Entry enforceable.
